Inovisi said that audited net profits had reached Rp 125.4 billion, a 346 percent increase from Rp 28.1 billion in the same period earlier. The company's total revenue in the 12 months period jumped by 372 percent to Rp 330.5 billion from Rp 88.7 trillion last year.

Inovisi president director Jerry Djajasaputra said that in the last 6 months of year 2010, all the Company's business's lines showed impressive performance, and that he expected the demand for the firm's products and services would remain high.

However, he reported the recent capex investment in oil & gas and coal mining business had stressed the company’s resources. "It’s a normal process for business diversification, we hope that the new ventures will give more investment return to shareholders in the long run," Jerry said in a press statement.

The company said its telecommunication infrastructure business generates the highest profits of all of its business units. The firm’s cloud data services now reach 40 million users per day, mostly from Asia Pacific countries including Indonesia. “Mobile Internet has boosted many suppliers in the eco-system, such as cloud player VMWare, Riverbed Technology, and Acme Packet, just to name a few listed on NASDAQ”, added Jerry.

According to BusinessWeek, as at 2 May 2011, VMWare, Riverbed Technology, and Acme Packet are valued at market capital of US$39b, US$5.2b, US$5.1b, and are traded at P/E of 111x, 157x, and 113x respectively.

Jerry said that Indonesia's strong economy, stable inflation rate and faster access to financing had boosted Inovisi’s businesses in the year 2010. The company strong financial performance will help finance business growth strategy by way of acquisition and investment in coming years.

"We hope that global and national economic conditions will get better despite several challenges, such as the oil and commodity price hike, which may slower demand, but overall does not slow down our M&A plans" he added.

From child piano prodigy to blues & jazz virtuoso to…rising hip/hop superstar? Oddly enough, this description only scratches the surface of Stereofame.com's May 2011 Artist of the Month, J. Dash.

The Florida native who was playing Mozart at age 8 is now busy crafting instant dance classics that are every bit as hot and sticky as the state he calls home. Despite already having a string of radio-ready, booty-shaking anthems to his credit, J. Dash considers himself to be a student of all styles of music. Between his roles as a rapper, songwriter, producer and multi-instrumentalist with a degree in computer science from the University of Florida (of all things), to say J. Dash wears many different hats would be an understatement.

"When I come across something I like I want to learn everything about it and really understand it," he said of his diverse musical tastes.

But for J. Dash, the world of hip/hop holds a special place in his heart.

"When I was growing up, hip/hop was kind of dangerous, it was music I wasn't supposed to be listening to," he said. "(I) would sneak out of the house to go see some underground show…and it just became a part of my soul."

Although having already amassed an impressive collection of material, J. Dash's pulse-pounding dance hit, "WOP," is starting to inspire some much-deserved buzz. Dash's friend and major label rapper Flo Rida, is quickly approaching ½ million views on YouTube since its release 4 months ago.    

"The WOP was a dance that me and my friends grew up doing, but we never had a name for it," J. Dash said, "I thought it looked like we were wopping and the name stuck. The track came together in about three hours."

In fact, J. Dash approached "WOP," with the same breakneck ferocity with which he approaches all of his music. Preferring to write his lyrics on the spot in the studio, J. Dash's rhymes have an urgency and spontaneity that is infectious.

According to J. Dash, through Stereofame's unique platform, he has been able to introduce a worldwide audience to his music in a brand new way.

"We have the power," he said of Stereofame's artist-friendly format. "We decide who we want to sign to our labels and it's all wrapped up in a game, how genius is that?"

With "WOP" poised to be a world-wide dance phenomenon, J. Dash isn't showing any signs of slowing down. A new album is slated for release next month and while J. Dash is tight-lipped about the details of the new record, he does offer one prediction.

"It's going to be big," he said. "All I'm going to say is 'I told you so.'"

Vegas tournament style Texas Hold’em Poker is a serious game of skill. And many players were competitively out to win the grand prize: a weekend in Las Vegas complete with show tickets, dinner for two, and spa package. “Austin Powers” actor, Vern Troyer, attended for the second year in a row; as well as singer, songwriter and musician Mitch Allan, who played until the chips ran out.

Probate is a court process that assets of a decedent must pass through before being distributed to his heirs or beneficiaries under a Will. Whenever a person dies with or without a Will, any assets held in their individual names are subject to the probate procedure.

"It is surprising to me how many people believe that assets must be probated before passing to a surviving spouse" says named partner Keith A. Davidson. "There are other methods that can be used, including a Spousal Property Petition to allow assets to pass to a spouse without having to engage in a full-blown probate." According to Davidson, the "Spousal Property Petition" is a summary filing that takes far less time and effort to complete than a regular probate procedure.

The petition is not only a time saver, it can also substantially reduce the costs of transferring assets to the surviving spouse. "The fees in probate are set by statute and are based on a percentage of the estate value" explains partner Stewart R. Albertson. "For example, the statutory fee for an estate valued at $500,000 is $13,000 for the attorneys and another $13,000 for the executor, for a total fee of $26,000." The fee increases with the amount of the estate, explains Albertson, so an estate valued at $1 million would have fees double this amount, or $54,000.

"These fees can be reduced to around $5,000 to prepare and file a Spousal Property Petition, that's a reduction in fees of $21,000—a real money saver" says Albertson. Unfortunately, few people are aware of the Spouse Property Petition option when a spouse dies. As a result, many spouses are forced to engage the probate process never knowing they could save themselves both time and money (substantial money) with the petition.

"Of course, probate only applies if a spouse failed to prepare a proper estate plan that includes a Trust" says Davidson. "And many people don't understand that a Will must pass through probate just like someone dying without a Will does. It is the Trust that makes the difference so that probate can be avoided altogether." However, if probate is a must because a Trust was not used, then at least with spouses there is an easier and less costly alternative by using the spousal petition.

Shale continues to take center stage, albeit with mixed opinions, which is adding volatility to the direction of natural gas prices.

EMR – Based on last months New York Mercantile Exchange (NYMEX), Natural Gas prices are holding between $4.20 to $4.30 per MMBtu. Many factors come into play with when pricing commodities on NYMEX; however, all eyes continue to focus on the game changer – Shale Gas. Energy Management Resources is seeing a lot of clients re-analyze their hedging strategies as a result.

Shale continues to take center stage, albeit with mixed opinions, as compared to previous robust projections. These mixed opinions are adding some volatility to the direction of natural gas prices. Yet, it looks like North American producers are scaling back due to economics.

Here are the some facts regarding the economics of shale gas:

  •     There are 2,300 drilled but yet to be completed wells in the Haynesville, Marcellus, Eagle Ford and Barnett plays alone. As a result, producers have an inventory position whose cost structure will continue to put price caps on future price increases.
  •     There are potential environmental hazards that can be associated with the process of drilling for shale gas. Consequently, larger investments may be needed to deal with any new regulatory oversight and unanticipated regulations.
  •     Storage and pipeline capacity limits are being tested, as U.S. dry natural gas production is expected to grow by about 5.4 Bcf/d through 2015 from the 2010 average.

What some know about this game-changer is that the new drilling technologies that have proved so successful for natural gas may now provide an impact on the world oil supply. Oil brings much higher returns than gas, so many investors have already begun to pressure Boards of Directors about their investments. While debt rollovers, new equity offerings, and asset lease sales have financed the shale gas boom, disappointing cash flows are leading some investors to jump off the bandwagon. A thousand cubic feet (Mcf) of U.S. natural gas once sold for a tenth of the price of a barrel of oil, but now that spread has widened tremendously – One (1) Mcf of gas now sells for a twentieth, or less, of the price of a barrel of oil. Major shale producers see today’s gas prices making the economics of shale gas, as well as conventional gas, increasingly unprofitable. Weak cash flows have spurred investor concerns that these companies may no longer be able to meet wellhead break-even costs at those prices.

  •     Chesapeake Energy Corporation announced they had decided to sell all of its Fayetteville Shale assets and its equity investments in Frac Tech Holdings, LLC and Chaparral Energy, Inc.
  •     Chesapeake also announced ramped up investments at the Niobrara oil/shale formation, primarily an oil play, situated in northeastern Colorado and parts of Wyoming, Nebraska, and Kansas.
  •     Voyager Oil & Gas has made similar investment decisions. It will reduce production in its Bakken shale formation and refocus on its Niobrara fields.
  •     In response to deteriorating, if not negative profit margins, other shale gas producers are suddenly redeploying their rigs to drill for more lucrative oil. That includes the likes of Petrohawk Energy Corporation, EOG Resources, Forest Oil Corporation, and Quicksilver Resources.

Low natural gas prices are the result of many factors and the technology behind shale gas is seen as the central game changer, as it may assume a similar role in oil exploration. Although the potential environmental impacts of producing shale gas are being questioned, shale gas producers are redeploying their drilling dollars to oil targets searching for higher returns. According to Baker Hughes last week, the number of natural gas rigs operating in the US fell for a fifth consecutive week to a ten-month low. By shifting from gas to oil, the technology has lifted hopes of the first significant rise of onshore U.S. oil production in decades. In five to eight years, the technology could add a million barrels of oil a day to U.S. supplies.

Analysts stress the importance of this switch in exploration activity. Moving from shale gas to oil won’t be without consequences for future gas supply, as the effect of more rigs drilling for oil will have an impact gas prices. The oil exploration industry has already moved to riskier finds, such as Alberta tar sands and deep-water drilling. There probably isn’t a whole lot of "easy oil" left to find. Thus, the oil industry thinks it can benefit from the shale gas technology developed by its siblings in the natural gas sector.

Many employers put broad restrictions on the use of social media by their employees with respect to posting commentary about the workplace. The assumption is that the employers have the right to do so because the factual scenario serving as the basis for the speech is taking place on their private property, and is therefore not subject to the same free speech requirements of a public setting. But in a recent court case, the settlement agreement reached included the employer's agreement that they could not "improperly restrict" employees from discussing their work on social networking websites, as doing so would constitute a violation of the National Labor Relations Act ("NLRA"). Ronnie Gipson, founding partner of San Francisco law firm Higa & Gipson, LLP, says employers should reexamine their restrictions on social networking; if their policies are overly strict, they may be risking a lawsuit.

In the precedent-setting case [Case No. 34-CA-12576] in Hartford, Connecticut, the employer, an emergency medical services provider, demanded that one of its employees submit a written incident report in connection with an ongoing investigation that had the potential to lead to disciplinary action for the employee. The employee requested that a union representative assist her with the preparation and submission of the incident report. The employer denied that request. The employee submitted the report and received disciplinary action as a result. The employee subsequently made entries on her Facebook account about the working conditions to include the incident and the people involved. When the company became aware of the postings, the employee was terminated for violating the company’s Internet posting policy.

"The pivotal issue is, 'Does the employer break the law by terminating an employee for submitting posts about the workplace to a social media website?' The short answer is 'Yes,'" Gipson, a San Francisco business attorney, explains on the Higa & Gipson, LLP blog.

The Hartford regional National Labor Relations Board ("NLRB") office issued a complaint in the case of American Medical Response of Connecticut Inc. and International Brotherhood of Teamsters, Local 443, NLRB Case No. 34-CA-12576 on October 27, 2010 to challenge the employer's restrictions using a law that governs labor practices: The National Labor Relations Act (“NLRA”), which protects the rights of employees to communicate with each other in order to better the working conditions of their collective employment. (Although the case referenced above includes a union, there is no need for the worker(s) to be represented by a union for the worker to receive the protection of the NLRA.)

From a legal standpoint, this case is very interesting because the policy issue being decided affects an employee’s free speech. However, the mechanism used to protect the free speech is not the 1st Amendment, but rather the NLRA, which governs fair labor practices. Some view this approach as an end-run around the public/private distinctions of the free speech analysis. The legal community, specifically the defense bar, is watching the case to see how far the NLRB goes in applying the NLRA.

This precedent may not stand if a similar case is decided in court, but in the meantime Gipson advises that companies review their policies restricting employee postings on social media websites. The best course of action is to consult with an attorney to determine if current company policies make the company vulnerable to employer lawsuits for a NLRA violation.
